Terms of Service

These terms govern your use of Planch Cloud. By creating an account you agree to them.

Planch Cloud is a service of Planch Digitals. Last updated 22 August 2026.

1. What we provide

Planch Cloud provides virtual Linux servers and related infrastructure — block storage, snapshots, scheduled backups, firewalls and reserved addresses — which you order and manage yourself through our dashboard.

The underlying infrastructure is operated by DigitalOcean. You are buying a service from Planch Digitals, not from DigitalOcean, and your agreement is with us. Our ability to deliver depends on their platform, and interruptions there may affect your servers.

2. Your account

You must give accurate registration details and keep them current. You are responsible for everything done under your account, including by anyone you give access to. Keep your password and SSH keys secure and tell us promptly if you believe your account has been compromised.

One person or organisation per account. Do not create accounts to evade suspension, limits, or amounts owed.

3. What you may not do

You may not use our service to:

  • break any applicable law, or infringe anyone's rights;
  • send unsolicited bulk email, or operate anything that gets our addresses listed as a source of abuse;
  • attack, scan or attempt to gain unauthorised access to any system, including ours;
  • run denial-of-service traffic, whether as the source or as a reflector;
  • distribute malware, host phishing pages, or knowingly host stolen data;
  • mine cryptocurrency, or run other workloads whose purpose is to consume as much shared capacity as possible;
  • resell the service as your own without a written agreement with us.

We may suspend a server immediately and without notice where it is actively causing harm — an ongoing attack, an active phishing page, or traffic that threatens other customers. Where the situation allows it, we will contact you first.

4. Prices, billing and payment

Servers are billed monthly and in advance. A billing period is 30 days. The price you see at checkout is the price charged, in the currency of your billing region.

An unpaid new order expires after 24 hours and the machine is not provisioned. Renewal invoices are raised automatically and are due within 7 days. If a renewal goes unpaid we allow a further 7 days before the machine is suspended — your server keeps running during that window, so a failed card does not cut off your access the same day.

A suspended machine stops serving traffic. Its data is retained for a period while you settle the balance, after which it may be destroyed permanently. Do not treat suspension as a backup: keep your own copies of anything you cannot lose.

We may change prices. Existing servers keep their price for the period already paid for, and we will give notice before a change takes effect on renewal. Prices are derived partly from our own supplier costs and an exchange rate we set, so a figure quoted in your currency may move between periods.

5. Cancellation and refunds

You may cancel a server at any time from the dashboard. Cancellation takes effect at the end of the period you have paid for. Refunds are covered separately in our Refund and Cancellation Policy, which forms part of these terms.

6. Your data and your content

You own what you put on your servers. We claim no rights over it, and we do not access the contents of your machines except where you ask us to in support, or where we must to comply with the law or to stop active harm.

You are responsible for backing up your own data. We provide snapshot and backup features, and using them is your decision. See our Privacy Policy for what personal data we hold about you and why.

7. Availability

We aim to keep the service available and will tell you about planned maintenance where we can. We do not currently offer a service level agreement with availability credits. Nothing here is a guarantee of uninterrupted service, and you should design for failure — including ours.

8. Suspension and termination

We may suspend or close an account for non-payment, for breach of these terms, or where required by law. Except where we must act immediately under clause 3, we will tell you the reason and give you a reasonable chance to fix it.

You may close your account at any time. Closing it does not waive amounts already owed.

9. Liability

To the extent the law allows, we are not liable for lost profits, lost revenue, lost or corrupted data, or business interruption. Our total liability for any claim is limited to what you paid us for the service in the three months before the claim arose.

Nothing in these terms excludes liability that cannot lawfully be excluded.

10. Changes to these terms

We may update these terms. Where a change materially affects you we will give notice before it takes effect, and continuing to use the service after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and its courts have jurisdiction over any dispute.
